NATURE OF THE DATA PROCESSED

The term ‘personal data’ means any information relating to a natural person, identified or identifiable, even indirectly, by reference to any other information (Art. 4, letter b, Code).

The personal data processed by Maina Panettoni S.p.A. are collected on the following grounds:

1. provided directly by the data subject; examples of data provided directly by data subjects include: name; e-mail address; postal address and telephone number; various information included when submitting a curriculum vitae; and, in general, any contact details, etc.
2. automatically collected. With regard to the use of cookies, further details can be found in our Cookie Policy. Maina Panettoni S.p.A. uses cookies on the Website for various purposes, including: identifying the user when logging into the Website; preventing fraudulent use of accounts; where authorized, providing the user with information about products of interest or other personalized content or offers; where authorized, delivering promotions, content, and advertising tailored to the user and their preferences; and conducting market research.
3. For the normal and proper functioning of the website, the processing of data falling within the categories defined by the GDPR as ‘special categories of personal data’ (Articles 9 and 10) is excluded. Users are therefore requested not to submit such types of data through forms, e-mails, or in any other way.

PURPOSES AND LAWFULNESS OF PROCESSING

The lawfulness of personal data processing is based on at least one of the legal grounds set out in Article 6(1) of the GDPR. With regard to this website, the legal bases are: the performance of a contract or pre-contractual measures (for account registration and any voluntary data submissions), and consent (for marketing activities, newsletters, or profiling).

Maina Panettoni S.p.A. uses the data provided by data subjects for the following purposes:

1. manage the accounts of users who register on the website in order to use the related services;
2. manage the data voluntarily provided in the ‘Contact Us’, ‘Work with Us’, and ‘Reports’ sections;
3. market research activities aimed, for example, at analyzing individual or aggregate consumption habits and choices, preparing statistics on them, or assessing the level of satisfaction with the products and services offered;
4. subject to express consent, the possible performance of direct marketing activities, such as sending — including by e-mail, SMS, and MMS — advertising material and communications of informational and/or promotional content relating to products or services provided and/or promoted by the Data Controller, including any gifts and free samples, promotional communications regarding active offers and promotions, as well as market surveys and statistical analyses carried out to improve the quality of the services provided, promotional activities, and commercial offers of the Data Controller. This also includes voluntary subscription to the Newsletter;

The provision of data for the purposes referred to in points 1 and 2, as they are necessary for registering on the website or for the use of specific communication tools with the Data Controller, is mandatory. Refusal to give the related consent to the Processing makes it impossible to provide the requested services.

The provision of data for the purposes referred to in points 3 and 4 is optional, and any refusal to provide such data and to give the related consent (through the checkboxes) will prevent the Data Controller from carrying out the activities indicated therein, but will still allow the user to benefit from the services referred to in points 1 and 2 above.

METHODS AND PLACE OF DATA PROCESSING

Data processing will mainly take place at the Controller’s headquarters, primarily through electronic tools, according to logics strictly related to the purposes indicated and in any case by adopting procedures and measures suitable to ensure security and confidentiality. Personal data may, in whole or in part, be made available to persons in charge of processing activities related to the pursued purposes, such as staff responsible for marketing and promotional activities, accounting, warehouse, and logistics.

The retention periods are determined by the obligations imposed by current legislation, and shall not exceed 10 years after the termination of the relationship (Art. 2220 of the Civil Code).

CATEGORIES OF RECIPIENTS TO WHOM THE DATA MAY BE DISCLOSED

Maina Panettoni S.p.A. undertakes not to sell or disclose the collected data to third parties under any circumstances, except upon request by judicial or public security authorities, or as required by civil and tax obligations. Data may be disclosed to service providers involved in the maintenance and management of the website. Data will also be communicated to processors appointed pursuant to Article 28 of the GDPR for the management of communications and promotional contests organized by the Controller. The updated list of data processors is kept at the Controller’s headquarters.

RIGHTS OF THE DATA SUBJECT UNDER ARTICLE 7 OF THE LEGISLATIVE DECREE 196/2003

As a data subject, you have the rights set out in Article 15 of the GDPR. Where applicable, you also have the rights set out in Articles 16–21 of the GDPR (right to rectification, right to erasure, right to restriction of processing, right to data portability, right to object), as well as the right to lodge a complaint with the Supervisory Authority.

Maina Panettoni S.p.A. reserves the right to amend, supplement, or update this Privacy Notice periodically, also in light of any changes in applicable legislation or measures issued by the Data Protection Authority.
